Black school kids charged with felonies for watching a fight
Staff Reporter | Posted May 5, 2009 12:34 PM
As school fights go, it was not necessarily unusual. The scuffle near a Leesburg High School bus stop in Florida last week involved two school kids settling a dispute.
But there were a couple of things about the fight that made it somewhat different. First, it was videotaped by a student on his cell phone and posted on the Internet on YouTube. But even that is not entirely unusual these days. A simple YouTube search for "school fight" turned up thousands of videos on that site. And that's to say nothing of the various web sites that specialize in posting videos of school kids fighting.
What made the fight particularly unusual is that the police chief in Leesburg, Florida chose to arrest and prosecute 12 school kids -- most of them young girls -- for simply watching the fight.
The police chief defended his decision to arrest the teen onlookers recently and told a group of concerned citizens that the fight was a planned event. He said some students sent text messages to each other to let them know about the fight earlier in the school day. Although no one was seriously injured, a dozen onlookers -- including the student who shot the cell phone video -- have been charged with various crimes, including inciting a riot.
Angry parents complained that their children had been suspended from school and would face a lifetime felony record if the charges are allowed to remain.
The fate of the students who watched the fight will depend on the state attorney, who will decide if the case against the kids should be prosecuted. Parents told the local news station WFTV that they hope to meet with the state attorney's office to get the charges dropped.

It is heart breaking to see kids fight and I would naturally want to punish them including the onlookers. And dont forget the parents! But to give kids a criminal record for life is absurd. I am not so sure what the right thing to do would be if another kid got badly injured or even died, since that's very possible. If the sherrif was black then it's likely the man was just so sick and tired and not thinking properly about the ultimate result of his action. If he was white, the possibility of racism is there: of attempting to brand black kids as criminals for life. But of course that'll be very hard to prove withoug knowing the man well.
Personally I would have taken the kids to a police station and kept them waiting for "questioning" for a good number of hours. Maybe including their parents.Eugene Robinson on the other hand would have video taped and broadcast the fight.
