Alan Keyes sues Obama to prove citizenship
Staff Reporter | Posted November 20, 2008 4:25 PMAlan Keyes just won't quit. The perennial black Republican candidate who lost to Obama in the 2004 Senate race, is now trying to sue Obama, claiming that the new president-elect was not born in the U.S.
Keyes filed suit in California Superior Court in Sacramento to stop the state from giving its electoral votes to Obama until evidence is shown to prove Obama was born in the U.S.
Keyes was the presidential candidate of the American Independent Party in the 2008 election and was reportedly listed on the California state ballot. He has run for office several times before and never won.
"Senator Obama has failed to demonstrate that he is a 'natural born citizen,'" Keyes said in his lawsuit (see PDF file here). He argues that failure to grant his request "will cast a pall of doubt on the election process and taint the election results themselves."
The story is old news for the Obama campaign. A web site run by the campaign disputes Keyes's claim and posts an actual copy of the president-elect's birth certificate (shown below). Several news agencies have also discounted the story.
The Washington Post investigated months ago and debunked the non citizenship story. And FactCheck.org, an independent research project of the Annenberg Public Policy Center at the University of Pennsylvania, also proved that Obama is, in fact, a natural born U.S. citizen.
The rumor resurfaced just a few days before the election, and on October 31 the Associated Press tracked down the Hawaii Health Department Director, Dr. Chiyome Fukino and the registrar of vital statistics, Alvin Onaka, who confirmed the authenticity of Obama's original birth certificate.
The facts: Obama was born in Honolulu, Hawaii on Friday, August 4, 1961 at 7:24 p.m.

...Really? Well humor me, because I think this is important enough for us to get our facts straight. So let's explore that. Hawaii doesn't issue "birth certificates". The state offers "Certificates of Live Birth" and "Certifications of Live Birth." What Barack Obama has posted on his website is a "Certification of Live Birth." So let's talk about the difference between the two documents. As you probably know, the document we commonly refer to as a "birth certificate" (more formally called a Certificate of Live Birth) is packed with detail. Detail like the hospital you were born in, the doctor who delivered you along with his/her signature, etc. It looks like a tax form with all the boxes and everything. The Certification of Live Birth is really just a snapshot of that. So which one is more credible? Which one does the state of Hawaii give the "last word" to? Based on information that existed long before this issue came up, let's take a look at what the state of Hawaii has to say on it:
"In order to process your application, DHHL utilizes information that is found only on the original Certificate of Live Birth, which is either black or green. This is a more complete record of your birth than the Certification of Live Birth (a computer-generated printout). Submitting the original Certificate of Live Birth will save you time and money since the computer-generated Certification requires additional verification by DHHL." (http://hawaii.gov/dhhl/applicants/appforms/applyhhl ).
So if the state of Hawaii itself doesn't accept "Certifications of Live Birth" as a last leg of verification, it's safe to say there's a pretty solid distinction we too can make when comparing a Certificate to a Certification. What Barack Obama posted, was a Certification. What people want to see, is the Certificate. When you say he "posted his birth certificate" on his website, the truth (painful as it may be to hear) is that he posted a much different document that if accurately described, would be a "birth certification" - which is far less credible and far easier to alter.
..."This is ridiculous" doesn't count as a refutation. Simply, answer the question with the simple documentation that is being asked of you in double digit numbers of court rooms across the country, including the Supreme Court. It may go away. It may be dismissed again based on standing. But President-Elect Obama's refusal to quell what have become very real questions about this, will only serve to leave many good Americans who hope to vigorously support their President...with far too much doubt to be able to do so. Production of a Certificate of Live Birth is a very small price to pay for unity.

As much as we would like to encourage people to keep running up our traffic on the web site, I have to put a stop to this.
Although I graduated from law school 16 years ago, any first year law student could probably tell you that there is virtually no difference between a "certificate" and a "certification" of live birth. It's just a different "term of art" used in different jurisdictions.
In fact, if you look up the word "certification" in Black's Law Dictionary, it points you to the term "certificate," which is often used interchangeably. But even if the two are different, it doesn't matter because the state of Hawaii has verified the authenticity of the document and the existence of the original document in its files.
Sadly, I am astounded at the level of ignorance reflected here about basic principles of law, language, common sense and the U.S. Constitution. Do you really think the Federal Election Commission, the Electoral College, and the U.S. Congress, all of whom must certify the validity of a presidential election, would be so easily duped (not to mention the media and the McCain campaign), only to be outwitted by a group of misinformed Internet bloggers?
